1. Introduction & Scope

Welcome to Nortix (“Nortix”, “we”, “us”, “our”). These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and Nortix regarding your use of the Nortix desktop launcher, website, marketplace, and related services (collectively, the “Services”).

By installing the launcher, creating an account, or making a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility & Age Requirements

2.1 Minimum Age

You must be at least 13 years of age to access or use the Services. If you are under 13, you are strictly prohibited from using the Service.

2.2 Purchasing Eligibility

To make purchases on the Nortix Marketplace (including "Seeds" or Partner Products), you must be either:

  • The age of majority in your jurisdiction of residence; or
  • Using the Services with the explicit consent and supervision of a parent or legal guardian.

3. Account Registration & Security

3.1 Account Creation

Access to certain features requires an account. You agree to provide accurate, current, and complete information during the registration process.

3.2 Credentials & Security

You are solely responsible for maintaining the confidentiality of your login credentials. You accept responsibility for all activities, financial or otherwise, that occur under your account.

4. Merchant of Record & Payment Terms

Nortix acts as the Merchant of Record (MoR) for transactions conducted within the Services, unless explicitly stated otherwise at checkout.

4.1 Payment Methods

We accept various payment methods, including credit cards, debit cards, digital wallets, and Direct Carrier Billing (DCB) via partners such as TPay.

4.2 Authorization

By initiating a transaction, you authorize Nortix (and our designated payment processors) to charge the full amount to your chosen payment method.

4.3 Carrier Billing Warning

If you choose to pay via mobile carrier billing (e.g., via TPay), charges will appear on your mobile phone bill. Note: While our Refund Policy (Section 7) outlines your legal rights, please be aware that Carrier Billing networks often have technical limitations that make transaction reversals difficult.

5. "Seeds" Virtual Currency System

Nortix operates a proprietary, closed-loop virtual currency system known as "Seeds."

5.1 Nature of Seeds

"Seeds" are not a personal property right or real-world currency. They represent a limited, non-exclusive, non-transferable, revocable license to access designated digital features.

5.2 Acquisition & Usage

  • Unified Balance: Seeds purchased with money and Seeds earned via gameplay are stored in a single wallet.
  • No Transfers: You may not sell, trade, or transfer Seeds to other users.
  • No Withdrawals: Seeds cannot be redeemed for cash.

5.3 Refunds on Seeds

Refunds for Seed purchases are governed strictly by the Refund Policy in Section 7. Specifically, if you have used any portion of a Seed pack, the remaining balance is non-refundable (see Section 7.6).

6. Digital Delivery Policy

Delivery is deemed complete the moment the content is provisioned to your account or the "Seeds" are credited to your balance. In rare cases of technical delays, delivery may take up to 24 hours.


7. Refund Policy

This section applies to all digital items, credits ("Seeds"), services, and marketplace products purchased by consumers (B2C) on the platform where Nortix acts as the Merchant of Record.

7.1 Right of Withdrawal

Consumers may withdraw from a purchase within 14 days of the transaction unless delivery of digital content has begun with the consumer’s explicit consent and acknowledgment of the loss of the right of withdrawal.

7.2 Unclaimed Items

Digital items that have not been claimed, accessed, downloaded, activated, or otherwise delivered are eligible for a full refund if requested within 14 days of purchase.

7.3 Claimed or Used Items

Once delivery has begun, a digital item is considered claimed. Claimed or used items, including spent credits/Seeds, are non-refundable.

7.4 Partial Use

If a purchase is partially used or claimed (e.g., using a portion of a "Seeds" pack), refunds apply only to the unused or unclaimed portion. The used portion is non-refundable.

7.5 Defective or Non-Conforming Content

If digital content or services are defective, unavailable, incorrectly delivered, or not as described, the platform may provide a repair, replacement, re-credit, partial refund, or full refund in accordance with applicable law.

Refund eligibility for third-party Partner Products sold via Nortix is governed exclusively by this policy, regardless of individual server owner terms or preferences.

7.7 Refund Processing

Approved refunds are issued using the original payment method and processed within 14 days of confirmation.


8. Chargebacks & Payment Disputes

8.1 No Override of Policy

Initiating a chargeback or payment dispute does not replace or override the platform’s refund process defined in Section 7.

8.2 Investigation Rights

Nortix reserves the right to investigate chargebacks, including reviewing usage logs, delivery records, IP addresses, and account activity.

8.3 Consequences of Chargebacks

If a chargeback is initiated for a claimed or used digital item, Nortix may, at its sole discretion:

  • Revoke access to the related product or service.
  • Deduct associated digital items or "Seeds" credits from the account (potentially resulting in a negative balance).
  • Suspend withdrawals, payouts, or account balances.
  • Temporarily or permanently suspend the user account.

8.4 Fraudulent Disputes

Chargebacks deemed abusive, "friendly fraud," or inconsistent with platform delivery records may result in immediate account termination.


9. Enforcement & Account Actions

9.1 Content Revocation

Nortix may revoke, disable, or remove any digital product, credit, or service from a user’s account in connection with a refund, chargeback, fraud investigation, or policy violation.

9.2 Account Suspension

We reserve the right to suspend or terminate accounts for:

  • Abuse of refund rights.
  • Excessive chargebacks.
  • Suspected fraud or money laundering.
  • Violation of platform policies.

9.3 Payment Restrictions

We may suspend or restrict payments, payouts, credits, or balances during investigations or enforcement actions.

9.4 Final Authority

All determinations regarding refunds, chargebacks, enforcement actions, and account status are made at Nortix’ sole discretion, subject to applicable law.


10. Third-Party Partner Products

10.1 Role of Nortix

We sell "Partner Products" (ranks, items, keys) for use on third-party servers. While we process the payment as the Merchant of Record, the fulfillment (the actual in-game use of the item) relies on the Partner Server.

10.2 Risk of Server Closure

You acknowledge that third-party servers are operated by independent entities. Nortix is not liable if a Partner Server shuts down, resets, or bans you, rendering purchased Partner Products unusable.

11. Disclaimer of Warranties

THE SERVICE AND ALL MATERIALS ARE PROVIDED "AS IS". Nortix DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Nortix SHALL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES. Nortix' AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO Nortix IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
